Luxuriousity Con Job!
Posted by OPENSTEP on Friday, September 26 @ 20:30:39 CDT
GNU A company named Luxuriousity has started rebranding OpenOffice.org for MacOS X X11 and selling it, but even worse, is claiming that this server is their official corporate support site! (You can find their website yourself via Google...I won't give them the honor of a link). I won't bother paying for one of their con CDs myself, but the official OOo OS X dimage contains GPL software, and if they didn't distribute the source code too...well... Anyone friends with a few lawyers or wanna try to get real contact info for that company? If you bought something from them, sorry dude, you got conned! You could've gotten it for free by downloading it or gotten it on CD from a legit company like BSDMall that actually provides support for their users and gives back to OpenOffice.org and the Mac OS X porting effort.

It has come to my attention that you are using the term "neooffice" on your webpage for your Mac OS X support for your "Luxuriousity Office" product which you resell from Santa Monica, California. "neooffice" is a registered word mark and is an officially registered trademark of Edward H. Peterlin. No use of this trademark has been granted for Luxuriousity or any other commercial company for use in sales of a Class 9 product, specifically entailing "computer programs for business and personal use, namely, word processing programs; graphics authoring programs; electronic spreadsheet programs; presentation graphics programs". This classification and description of goods is clearly the classification of your "Luxuriousity Office" product.

I respectfully ask that you refrain from using or embedding the registered word mark "neooffice" within all of your sales and software support pages or else I shall be forced to undertake legal measures to protect this trademark under United States trademark law.

regards,
ed peterlin

I checked out Luxuriousity's site and I must say that the site makes me think it is run by two people who know how to stamp CDs. I really can't imagine who would be convinced to hand over their credit card to this site. But then maybe many people are ignorant of the free (or better supported) options available to them.

Even though it seems like a lousy business model to me, unfortunately, I think we are going to see more and more of these two of "no-value-add" businesses.

I fully support companies like RedHat and BSDMall that add value to open source. After all, some people need support and are willing to pay for it. The "no-value-add" companies, however, only give users a bad experience with open source software and, in my mind, these types of businesses can only cause open source developers and legitimate companies like RedHat and BSDMall trouble.

I am glad that Ed is taking the time to agressively curtail such unwarranted usage of open source efforts.

Just my two cents,

Patrick
