They're not using the OpenOffice.org trademark and they acknowledge (sort of) that their (again, "their") product is based on OpenOffice.org at the bottom of each page. Since OpenOffice.org is released under the LGPL, I'm not sure they can do much about it.

However, it looks like they may be distributing official builds (which could make a difference). As for NeoOffice, they're definitely using the trademark ...

Do you have a link to one of the pages that has NeoOffice in it? I couldn't find any usage of our trademark.

The links provided by trishff link to NeoOffice binaries (although we don't know whether they have charged for it - and the links are publicly accessible). BTW, do you remember the byte count for the Aqua Beta 3 PowerPC .dmg ?

Edit : They're definitely providing your build (I managed to crash it with bug 2475 and obtain a crash log). Of course, unless we can prove that they're charging for the code ...

The point is that they call it NeoOffice and charge money for it (more than it costs to distribute). I recall that is specifically not allowed under the trademark usage guidelines here.

Yes i did pay the $47. When the NeoOffice website then asked for a donation, i then asked them if I needed to pay something again, and they said not as i'd already paid the $47!!!

I must say I was surprised to have to pay as I had been told OpenOffice was free, but $47 instead of whatever Microsoft charge didn't seem much!

I'll see if I can retrieve the money as I never got the product, and it seems unlikely that it has come to NeoOffice.

I have not seen any payments from this site so I think it is safe to say that they are pocketing the entire amount.

You can always try filing a dispute for the credit card transaction with your credit card company and document that they sold you a pirated copy of another organization's trademarked software. If your dispute claim successfully, not only will your purchase be refunded, but the vendor will get hit with a $25 chargeback fee.
